1. Services Offered

Websites Daily provides website setup, design, preview creation, editing assistance, and transfer services, including:

• Custom website design and development
• Free website previews for prospective clients
• Website setup and initial configuration
• Assistance with AI-powered editing during the service period
• Website transfer to your platform account
• Domain connection assistance and SSL certificate management

Important: The underlying AI-powered website platform used to build and host your website is provided by a third-party provider. This platform is not owned, operated, or controlled by Websites Daily. After your website is transferred to your account, it will be hosted and managed through this third-party platform.

2. Free Website Preview

Our free website preview offer allows potential clients to receive a customized website preview before making a purchase decision. By requesting a free preview, you agree to:

• Provide accurate and complete information about your business
• Use the preview for evaluation purposes only
• Not reproduce, copy, or distribute the preview design without our consent
• Respect our intellectual property rights

3. Payment Terms

Pricing: All prices are listed in USD and are subject to change with notice.

Payment Schedule:

• Website packages (Starter $297, Growth $397, Pro $497) are paid upon approval of your website
• $24/month Websites Daily AI Website Platform subscription for ongoing service
• No refunds once final approval is given and files are delivered

Satisfaction Guarantee: If you are not satisfied with your website, we will make reasonable revisions until you are happy with the result. If we cannot resolve your concerns, a refund may be considered on a case-by-case basis.

4. Third-Party AI Website Platform

Platform Provider: The AI-powered website platform that hosts your website after transfer is provided by a third-party provider. This platform is not owned, operated, controlled by, or affiliated with Websites Daily.

Platform Subscription: After your website is transferred to your account, the $24/month platform subscription is paid directly to the third-party platform provider—not to Websites Daily. This subscription covers:

• SSL security certificate
• Daily backups
• Website hosting and infrastructure
• AI-powered editing tools
• Technical support through the platform provider

Platform Terms: By using the third-party platform, you agree to the platform provider's terms of service, privacy policy, and acceptable use policies. Please review these documents carefully, as they govern your use of the platform after website transfer.

Pricing Changes: The third-party platform provider may change their pricing at any time. Websites Daily has no control over and is not responsible for platform subscription rates, billing cycles, or fee adjustments made by the third-party provider.

Account Management: After transfer, you will manage your platform account directly with the third-party provider. This includes account credentials, billing information, and subscription management.

5. Client Responsibilities

You are responsible for:

• Providing accurate and complete business information
• Ensuring you have the rights to use any content, images, or materials provided
• Reviewing and approving website designs in a timely manner
• Maintaining accurate contact information
• Prompt payment of all fees to Websites Daily

Post-Transfer Responsibilities: After your website is transferred to your platform account, you are solely responsible for:

• Maintaining your account with the third-party platform provider
• Paying the $24/month platform subscription directly to the third-party provider
• Managing your domain name and DNS settings independently
• Reviewing and complying with the third-party platform's terms of service and privacy policy
• All content, updates, and changes made to your website after transfer
• Data backups beyond what the platform provides

Domain Registration: Domain registration is separate from both Websites Daily's services and the platform subscription. If you need a domain name, you may register one independently or through the platform provider. You are responsible for domain management, renewals, and DNS configuration.

6. Intellectual Property

Upon full payment, you will own the website design and content created specifically for you. We retain ownership of:

• General design concepts, frameworks, and templates used across multiple projects
• Stock images and assets licensed for use in multiple projects
• Our proprietary tools and processes

We reserve the right to display completed work in our portfolio unless otherwise agreed in writing.

7. Limitation of Liability

To the fullest extent permitted by law, Websites Daily shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our services.

Third-Party Platform Disclaimer: Websites Daily is not responsible for any issues, errors, or disputes arising from the third-party AI website platform. This includes, but is not limited to:

• Billing disputes, subscription changes, or payment issues with the platform provider
• Changes to platform pricing, features, or subscription terms
• Platform outages, downtime, or service interruptions
• Software errors, bugs, or technical issues with the platform
• AI-generated content mistakes, inaccuracies, or problematic outputs
• Account access problems, login issues, or authentication failures
• Security vulnerabilities, data breaches, or unauthorized access to your platform account
• Deleted, lost, or corrupted content on the platform
• Domain-related issues, including DNS problems, domain expiration, or transfer disputes
• Changes to the platform's terms of service, privacy policy, or acceptable use policies
• Platform discontinuation, discontinuation of features, or changes to platform availability
• Quality or accuracy of AI-generated content

Platform Issues: Any issues related to the third-party platform—including billing, technical support, account access, service quality, or disputes—must be resolved directly with the platform provider. Websites Daily has no authority to modify, access, or manage your platform account.

Service Availability: Websites Daily does not guarantee the continuous availability of the third-party platform. Platform features, pricing, terms, and availability are subject to change by the platform provider without notice to you.

8. Revisions and Changes

Each website package includes a specific number of revision rounds as outlined in your selected plan. Additional revisions beyond the included amount may be subject to additional fees.

After final approval, additional changes will be billed at our standard hourly rate.

9. Termination

We reserve the right to terminate services at our discretion if:

• You violate these Terms
• Payment is not received within 30 days of the due date
• You engage in fraudulent, abusive, or illegal activity
• The content you provide violates third-party rights

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Arizona.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or by posting a notice on our website. Your continued use of our services after such changes constitutes acceptance of the updated Terms.
